Wisconsin man charged with marijuana possession

A 28-year-old man was taken into police custody Nov. 7 after allegedly picking up a package of marijuana from the post office. After police searched the package, they claim to have discovered 2.5 pounds of marijuana. The accused man was then taken to Sauk County Jail and charged with felony marijuana possession with intent to deliver.

According to the Reedsburg police chief, the drug charges resulted from the efforts of both the U.S. Postal Service and the Sauk County Drug Task Force. After U.S. Postal Inspectors alerted police about the package, a K-9 unit was sent to conduct a smell test. When the scent of narcotics was detected, a warrant was issued to search the package for drugs.

Police say the package of alleged marijuana had been shipped from the state of California and was addressed to the accused man. When the man attempted to pick it up, he was taken into custody and charged. Following the incident, the Reedsburg police chief issued a public statement pointing out the importance of the Sauk County Drug Task Force. He also commented that drug investigations like this one rely on several law enforcement agencies cooperating with each other.

Although police may have discovered marijuana in the package, the accused man did not necessarily know what was being sent to him. In order to get a conviction, the prosecution will have to present evidence that the man had prior knowledge of what was in the package. A lawyer may help the man in his defense by challenging the prosecution on this point. A lawyer may also look for evidence of an illegal search by examining the details of the search warrant that was issued.
